Who we are

We are SmartShift Energy Ltd (“we”, “our”, “us”), a private limited company registered in the United Kingdom with Companies House (Company Number: 15474209) and we operate under the trading name SmartShift. These Terms and Conditions ("T&Cs") govern your use of the SmartShift website and services (collectively, the "Service") operated by SmartShift Energy Ltd. 

By using our Service, you accept our T&Cs in full. We regularly review our T&Cs and will notify you of any significant changes. The latest version will always be available on our website. Our T&Cs should be read in conjunction with our Privacy Policy, available here: https://www.smartshift.energy/privacy-policy.

Service description

SmartShift provides an online comparison service for smart electricity tariffs. Our Service allows you to:

  • Create and manage a personal account to provide the necessary personal information;

  • Provide your consent for us to access your smart meter data;

  • View personalised electricity tariff recommendations in your account dashboard;

  • Save and return to your personalised results and recommendations;

  • Edit your entered personal details and communications preferences.

To provide these services, we work with Perse Technology Ltd to access your smart meter data, following your provision of consent. You can find out more about Perse and their privacy policy here: https://www.perse.io/privacy-policy.

User registration and account management

To use certain features of our Service, you must register for an account by submitting some personal information and details on your home. We require that you:

  • Be at least 18 years old;

  • Be a resident of the United Kingdom;

  • Provide accurate, current, and complete information;

  • Create a secure password and keep your account credentials confidential;

  • Not share your account with any third party;

  • Update your account information promptly if it changes.

 

You are responsible for:

  • Maintaining the confidentiality of your account and password;

  • Restricting access to your computer or device;

  • All activities that occur under your account.

 

If you believe your account has been compromised, you must notify us immediately at hello@smartshift.energy.

 

We reserve the right to disable any user account if, in our opinion, it is being improperly used or has been compromised.

Account security

We implement appropriate technical and organisational measures to protect your account information. However, we cannot guarantee absolute security.

 

You agree to:

  • Choose a strong password for your SmartShift account;

  • Not use the same password you use for other online services or accounts;

  • Log out of your account when using shared devices;

  • Notify us immediately of any unauthorised access to, or use of, your account.

Data storage and retention

When you create an account with us:

  • Your account information, smart meter data and tariff comparison data will be stored securely;

  • You can access your comparison results and recommendations through your account dashboard;

  • Your data will be retained for as long as your account remains active, plus a reasonable period thereafter as outlined in our Privacy Policy;

  • You may request deletion of your account and associated data at any time by contacting us.

Smart meter data access

To provide personalised tariff comparisons, we require access to your smart meter data. This access is:

  • Provided through our trusted partner, Perse Technology Ltd, who obtain the data via the Data Communications Company (DCC), the regulated company responsible for managing GB smart meter data, and a DCC Adaptor, being a third party technical interface with the DCC.   • Subject to your explicit consent;

  • Used only for the purposes specified in these T&Cs and in accordance with our Privacy Policy;

  • Secured and protected in accordance with data protection laws.

You may withdraw your consent for smart meter data access at any time, but this may limit our ability to provide you with personalised comparisons.

Account termination and closure

You may close your account at any time by contacting us at hello@smartshift.energy. We may terminate or suspend your account immediately, without prior notice or liability, if you:

  • Breach these T&Cs;

  • Fail to log in to your account for an extended period (12 months or more);

  • Provide false or misleading information;

  • Are suspected of misusing the Service.

Upon account termination:

  • Your right to use the Service will cease immediately;

  • We may retain certain information as required by law or as necessary for our legitimate business purposes;

  • We will handle any remaining personal data in accordance with our Privacy Policy.

Your obligations

You agree to:

  • Provide accurate and complete information when using our Service;

  • Use the Service only for lawful purposes;

  • Not attempt to gain unauthorised access to our Service or systems;

  • Not interfere with or disrupt the operation of our Service;

  • Not use our Service in any way that could damage, disable, or impair it.

You acknowledge that:

  • The accuracy of our comparisons depends on the accuracy of the information you provide;

  • We rely on data from third parties, which may not always be complete;

  • Tariff availability and prices may change before you complete a switch.

Intellectual property

All content on our Service, including but not limited to text, graphics, logos, images, and software, is our property or that of our licensors and is protected by UK and international copyright laws.

You may:

  • View, download, and print pages from our website for your personal use;

  • Share and store content for your personal, non-commercial use.

You must not:

  • Republish material from our website without attribution;

  • Sell, rent, or sub-license material from our website;

  • Reproduce, duplicate, copy or otherwise exploit material on our website for commercial purposes;

  • Redistribute content from our website, except for content specifically made available for redistribution.

Service availability and updates

We aim to ensure our Service is available 24 hours a day, but we do not guarantee:

  • Uninterrupted access to our Service;

  • That our Service will be error-free or free from viruses;

  • That defects will be corrected;

  • That results obtained through our Service will be accurate or reliable.

We reserve the right to:

  • Modify or withdraw the Service without notice;

  • Change these T&Cs from time to time;

  • Restrict access to some or all of our Service.

We will try to give reasonable notice of any major changes to our Service or these T&Cs.

Liability

We provide our Service "as is" and do not make any representations or warranties about the accuracy, completeness, or suitability of the information and materials found or offered on our Service.

We will not be liable for:

  • Any indirect or consequential loss or damage;

  • Loss of data, profits, revenue, business, or opportunity;

  • Any loss or damage arising from your reliance on information obtained through our Service;

  • Any loss or damage arising from your inability to access our Service;

  • Any loss or damage arising from unauthorised access to or use of our servers.

Nothing in these T&Cs excludes or limits our liability for:

  • Fraud or fraudulent misrepresentation;

  • Any matter for which it would be unlawful for us to exclude or limit liability.

Third party links and resources

Our Service may contain links to third-party websites and resources. We:

  • Have no control over these websites and resources;

  • Are not responsible for their content;

  • Do not endorse them or their use.

You acknowledge that:

  • We are facilitating switches to energy suppliers as an independent intermediary;

  • The contract for energy supply will be between you and the chosen supplier;

  • We are not responsible for the performance of any energy supply contract.

Termination

We may terminate or suspend your access to our Service immediately if you:

  • Breach these T&Cs;

  • Fail to pay any amount due (if applicable);

  • Are suspected of misusing the Service;

  • Provide false or misleading information.

Upon termination:

  • Your right to use the Service will cease immediately;

  • You must cease all activities authorized by these T&Cs;

  • Some sections of these T&Cs will continue to apply.

General

These T&Cs constitute the entire agreement between us regarding your use of our Service.

If any part of these T&Cs is determined to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

Our failure to enforce any right or provision of these T&Cs will not be considered a waiver of those rights.

We may assign our rights and obligations under these T&Cs without your consent to any subsidiary, affiliate, or successor.

Governing law and jurisdiction

These T&Cs are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under this policy will be resolved through the legal procedures applicable in England and Wales.
